Engerman 4 Mayor SMS Program

Effective Date: October 2, 2025

Agreement to Terms

By requesting, joining, agreeing to, enrolling in, signing up for, acknowledging, or otherwise consenting to receive one or more text messages from Engerman 4 Mayor ("Sender", "we", "us", "our") through our messaging platform ("Platform"), you accept these Terms & Conditions ("Opt-In").

Opting In

You authorize Sender to use auto dialer or non-auto dialer technology to send text messages to the cell phone number associated with your Opt-In (i.e., the number listed on the Opt-In form or instructions, or, if none, the number from which you send the Opt-In, or, if none, the number on file for the account associated with your Opt-In, or publicly available voter registration records).

You also authorize Sender to include campaign content in any such messages. You do not have to Opt-In or agree to Opt-In as a condition of donation or support for our campaign.

You confirm that you are the subscriber to the relevant phone number or that you are the customary user of that number on a family or business plan and that you are authorized to Opt-In.

You consent to the use of an electronic record to document your Opt-In.

You agree that, in addition to the main messages that Sender may provide, you may receive one or more welcome messages or administrative messages, such as (in some cases) a request to confirm your Opt-In.

Program Description

The Engerman 4 Mayor SMS program provides campaign updates, event information, volunteer opportunities, and get-out-the-vote reminders related to Tracy Engerman's campaign for Mayor of Castle Pines, Colorado in the November 4, 2025 municipal election.

About the Text Message Services

Message and data rates may apply. You must have a wireless device of your own, capable of two-way messaging, be using a participating wireless carrier, and be a wireless service subscriber with text messaging service. Not all cellular phone providers carry the necessary service to participate. Check your phone capabilities for specific text messaging instructions.

Carriers are not liable for delayed or undelivered messages.

Message Frequency

Unless otherwise noted, Sender may send multiple, recurring messages and frequency may vary. You will receive approximately 2-4 text messages between October 2025 and November 2025. Message frequency may vary based on campaign activities and proximity to Election Day.

Sender may terminate any messaging services or your participation in it at any time with or without notice, including, for example, before you have received any or all messages that you otherwise would have received, but these Terms & Conditions still will apply.

Opting Out

You may text STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to opt-out of messages. Your opt-out request will generate a confirmation text. You also understand and agree that any other method of opting out, including, but not limited to, texting words other than those set forth above or verbally requesting one of our employees to remove you from our list, is not a reasonable means of opting out.

You may receive an additional mobile message confirming your decision to opt out. These Terms & Conditions still will apply if you withdraw the consent mentioned above.

Privacy and Data Handling

You consent to the handling of your information as described in our Privacy Policy at engerman4mayor.com/privacy-policy.

Important: No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. Carriers are not liable for delayed or undelivered messages.

Age Requirements

You may not use or engage with the Platform if you are under thirteen (13) years of age. If you use or engage with the Platform and are between the ages of thirteen (13) and eighteen (18) years of age, you must have your parent's or legal guardian's permission to do so.

By using or engaging with the Platform, you acknowledge and agree that you are not under the age of thirteen (13) years, are between the ages of thirteen (13) and eighteen (18) and have your parent's or legal guardian's permission to use or engage with the Platform, or are of adult age in your jurisdiction.

By using or engaging with the Platform, you also acknowledge and agree that you are permitted by your jurisdiction's applicable laws, rules, and regulations to use and/or engage with the Platform.

Supported Mobile Carriers

Our SMS service is available on all major U.S. mobile carriers including AT&T, T-Mobile, Verizon Wireless, Sprint, Boost Mobile, Cricket Wireless, MetroPCS, U.S. Cellular, and other compatible carriers. Not all carriers or devices are supported.

Message Delivery and Timing

Messages are typically sent between 8:00 AM and 9:00 PM Mountain Time to comply with federal telecommunications regulations. We make reasonable efforts to deliver messages in a timely manner, but we cannot guarantee message delivery. Carriers are not liable for delayed or undelivered messages.

User Responsibilities

You are responsible for maintaining an active mobile phone number and notifying us if you change your phone number. You are responsible for any charges from your mobile carrier.

Disclaimer of Warranties

The Engerman 4 Mayor SMS program is provided "as is" without warranties of any kind, either express or implied.

Limitation of Liability

Engerman 4 Mayor, its staff, volunteers, and service providers are not liable for delayed, failed, or undelivered messages, charges from your mobile carrier, service interruptions, or technical problems. Carriers are not liable for delayed or undelivered messages.

Changes to Terms

We reserve the right to modify these Mobile Terms & Conditions at any time. Changes will be effective immediately upon posting to this page with an updated "Effective Date." Your continued participation in the SMS program after changes are posted constitutes acceptance of the new terms.

We may also modify or discontinue the SMS program at any time, including after the November 4, 2025 election, with or without notice.

Legal Compliance

This SMS program complies with the Telephone Consumer Protection Act (TCPA), Federal Communications Commission (FCC) regulations, and CTIA Messaging Principles and Best Practices.
